The deconstitutional momentum: the exception as a paradox of the democratic social rule of law

We currently live in a social, political and legal ‘grey area’ or ‘zone of indeterminacy’, where the constitutional democratic model, on the one hand, is pitted against anti-democratic, populist and authoritarian tendencies, on the other. This process, and the conflicts associated with it, is referred to as ‘deconstitutional momentum’. It is within the framework of this argument that the author maintains that the exception acts as the ‘engine of history’, eroding the principles of the democratic social rule of law without subverting them entirely. The paradox thus becomes a normalising principle of the social, political and legal ‘zone of indeterminacy’.
